How Texas Rideshare Insurance Coverage Works
Texas regulates transportation network companies through Chapter 2402 of the Texas Occupations Code and Chapter 1954 of the Texas Insurance Code. Those statutes divide coverage into three distinct periods, and the compensation available to an injured person depends entirely on which period applies to the crash.
The three coverage periods under Texas law:
- App off: The driver’s personal auto insurance applies. Uber and Lyft’s commercial policies don’t cover this period at all.
- App on, waiting for a request: Texas law requires the transportation network company to maintain at least $50,000 in liability coverage per person, $100,000 per incident, and $25,000 for property damage.
- Trip accepted or passenger in the vehicle: Both Uber and Lyft carry $1 million in third-party liability coverage, plus contingent uninsured/underinsured motorist coverage.
That $1 million figure matters, but it doesn’t mean payment is certain. Insurers can still dispute who caused the crash, whether your injuries are related, or what the claim is worth. Evidence is what moves a dispute toward resolution. We build that evidentiary record from the start.
